Terms of service
These are the conditions under which a gym subscribes to WeAppGym. They are written to be understood; if something is unclear, write to us before accepting it.

1. Who provides the service
You are contracting with WeAppGym (weappgym.com), who provides the service and who charges you. It is also the name you will see on your card statement, whether you pay in pesos or in dollars.
In Argentina the charge goes through Mercado Pago. Outside Argentina it is processed by Polar as merchant of record: Polar issues the invoice on our behalf, and the charge still shows as WeAppGym.
The product is built by two brands of the same business — WeWeb (weweb.com.ar) in Argentina and Latin America, and WeAppGo (weappgo.com) in the rest of the world — which is why you will see them credited in the footer. They build it; they are not who sells it to you.
In these terms, “we” means WeAppGym, and “you” means the gym subscribing.
2. What the service includes
A public site for your gym, a panel for you and your team, and an app for your members: sign-ups, plans, payments, class schedule, routines and notices. What each plan includes is on the pricing page, and that is what you are contracting.
Your site lives on a weappgym.com subdomain and you can point your own domain at it. The content you upload — text, photos, videos, prices — is yours and remains yours.
3. Your account and your team
Each plan sets how many panel accounts you can have. You are responsible for who signs in under your gym and for what they do: when someone stops working with you, remove their access.
You can ask us for help getting into your account, but we will never ask you for your password.
4. Prices, billing and renewal
Prices are published in US dollars. In Argentina they are charged in pesos at the official rate through Mercado Pago; everywhere else, in dollars through Polar. Applicable taxes are added according to your country.
The subscription renews on its own at the end of each period — monthly or yearly, whichever you chose — until you cancel. If your plan has a free trial, the first charge happens when it ends.
We can change prices with at least 30 days' notice. The change applies at your next renewal, never to a period you already paid for.
5. Cancellation and refunds
You can cancel whenever you like, from your panel. You keep access until the end of the period you already paid for, and nothing further is charged.
We do not refund periods already started, unless the service was down through our fault for long enough to warrant it, or the law of your country says otherwise. That is what the free trial is for: to try it before paying.
6. Your members' data
Your members' data is yours, not ours. We store and process it on your behalf and on your instructions, under the Data processing agreement, which forms part of these terms and is accepted together with them.
On request we give you two things about your own people: your members' contact list — first name, surname, email and phone — and the history of the payments you charged them, as files any spreadsheet opens. We do not hand over copies of the database or of any part of the system: what is handed over is your members' data, not a copy of the product.
When you leave, everything is deleted. The timescales are in the agreement.
7. What you may not do
Publish illegal content, content belonging to others without permission, or content that passes your gym off as another. Use the service to send unsolicited messages to people who are not your members. Attempt to reach another gym's data, or probe for security flaws without telling us first.
You are responsible for what you publish on your site and for holding the rights to the photos and videos you upload.
8. Availability and support
We work to keep the service available, but we do not promise a percentage: we do not yet have the track record to promise one honestly, and we would rather not promise than break a promise. We perform maintenance and try to make it unnoticeable.
Support is provided through the channels published on the site, in Spanish, English and Portuguese.
9. Liability
The service is provided as is. We are not liable for lost profits, lost customers or indirect damages.
If something goes wrong through our fault, our total liability is capped at what you paid us in the 12 months before the event. None of this limits what the law does not allow to be limited, such as wilful misconduct or personal injury.
10. Suspension
If an invoice goes unpaid we tell you, and you have 15 days to settle before we suspend panel access. Your public site and your data remain for a further 60 days; after that they are deleted.
We can immediately suspend an account doing something illegal or putting other customers' service at risk, and we explain it to you in writing.
11. Changes to these terms
If we change something substantive we give you 30 days' notice at your account email. If you disagree, you can cancel before it takes effect, at no cost.
We keep the version you accepted and the date, so it is always possible to know which text you contracted under.
12. Governing law
Argentine law applies and the courts of the Province of Buenos Aires have jurisdiction, which is where the party providing the service is based.
If you are a consumer and your country's law gives you a forum of your own, that forum prevails over the above.
